I. Policy Statement:
It is the policy of the Directors of the Southwest Vermont Supervisor Union, Bennington School District, Inc., Mount Anthony Union School District, North Bennington Graded School District, Pownal School District, Shaftsbury School District, and Woodford School District board that because the use of tobacco by any person on school grounds is a violation of state law, it is hereby prohibited. The possession and/or
use of tobacco by any student, on school grounds or at school sponsored functions whether on or off school grounds, is also a violation of law hereby prohibited.
The Superintendent or his or her designee is directed to take reasonable steps to inform students and employees of this policy, to post signs on school property, and to provide notice to visitors and to individuals invited onto school grounds. The Superintendent or his or her designee shall provide notice of this policy in bulletins, programs, and announcements related to school sponsored functions.
III. Corrective Action:
Any staff member who has observed a student violation of this policy will attempt to confiscate the tobacco product and/or evidence substantiating its use. Where applicable, law enforcement will be contacted.
Students who violate this policy will be disciplined under school disciplinary policies and procedures. School principals, under the supervision of the Office of the Superintendent, shall be responsible for drafting regulations for each of their respective schools setting forth appropriate sanctions for non-compliance with this policy.
Employees who violate this policy will be subject to disciplinary action in accord with applicable employee policies, employment contracts, and requirements of law.
C. Visitors and others:
Others who use tobacco on school grounds will be informed of this policy and asked to comply. A person failing to comply will be asked to leave school grounds. A person who refuses to comply or to leave school grounds when requested to do so under this policy may be referred for prosecution as a trespasser.
A. “Person” means any student, employee, visitor, or any other individual entering the school grounds.
B. “School grounds” means any property and facilities owned or leased by the school and used at any time for school related activities, including but not limited to school buildings, areas adjacent to school buildings, school buses, athletic fields, and parking lots.
C. “School sponsored functions” means any school related function that is sponsored, organized, directed, or provided by the school, including but not limited to field trips and athletic events.
